Umar Khalid Case: The hearing on the bail plea of ​​former student leader of Delhi’s Jawaharlal Nehru University (JNU) Umar Khalid has been postponed again in the Supreme Court. This has happened to him not 2-4 or 6 times but for the 14th time in about 4 years. On Wednesday (February 7, 2024), the Top Court postponed the hearing on his bail petition.

Umar Khalid was arrested in September 2020 under the Unlawful Activities (Prevention) Act i.e. UAPA and this case is related to the communal violence that broke out (in February) in the north-eastern part of the country’s capital Delhi.   • On September 14, 2020, the Special Cell of Delhi Police arrested the former JNU student as the ‘key conspirator’ in this case. Apart from UAPA, he was then charged with treason and 18 other sections of the IPC (including murder and attempt to murder).
  • In April 2021, Umar Khalid got bail from the Sessions Court of Delhi in one of the cases registered against him, but there were allegations against him in other FIRs, hence he had to remain in judicial custody even after bail.
  • On March 24, 2022, after 8 months of hearing, the Sessions Court of Delhi had clearly refused to grant bail to the former JNU student.
  • On April 22, 2022, Umar Khalid had approached the Delhi High Court and challenged the order of the Sessions Court there.

  • After this, the court had ordered that the case will be heard continuously from May 23, 2022 so that the hearing can be completed before the summer vacation of Delhi High Court.

  • On June 4, 2022, the summer break of Delhi High Court had come, due to which the hearing was adjourned till July 4, 2022.

  • Then on October 18, 2022, Delhi High Court rejected the bail plea of ​​Umar Khalid. The court had found that he was in constant touch with other accused and whatever allegations were initially made against him were found to be true. The court had also said that whatever the accused did was initially considered as terrorist activities (under UAPA). For this reason he had to stay in jail for 764 days.

  • On November 18, 2022, Umar Khalid approached Karkardooma Court of Delhi. He had sought interim bail for two weeks there to attend his sister’s marriage.

  • On December 3, 2022, Karkardooma Court acquitted Umar Khalid in a case related to stone pelting but kept him in custody in connection with a bigger conspiracy related to the riots in Delhi.

  • On 12 December 22, Umar Khalid was granted interim bail but he was clearly forbidden to talk to the media.

  • He came out of jail on 23 December 2022. After being in captivity for 830 days, he got relief for only seven days. This relief was till December 30, 2022.

  • On April 6, 2023, Umar Khalid filed a special leave petition in the Supreme Court against the order of Delhi High Court.

  • Further, on June 9, 2023, he completed 1000 days in jail. During this time, many students, civil rights activists and media people also came in support of Umar Khalid.

  • Then on July 12, 2023, Delhi Police asked for additional time to prepare the argument.

  • Umar Khalid’s lawyer Kapil Sibal was not available. In such a situation, the hearing got postponed for a week on 24 July 2023.

  • On August 9, 2023, Justice PK Mishra had recused himself from the case without any reason. This was the reason why the hearing was postponed.

  • On August 17, 2023, Umar Khalid’s bail petition was listed before the bench comprising Justice Mishra and this happened after he had recused himself from the case.

  • On August 18, 2023, Umar Khalid’s bail came before the bench of Justice Aniruddha Bose and Justice Bela M Trivedi. The judges had then said that the case should be heard on a non-miscellaneous day.

  • On September 5, 2023, the former JNU student’s lawyer Sibal was no longer available. He was busy with the issue related to Article 370.

  • On September 12, 2023, the hearing was adjourned for a month. The court then said that ‘detailed hearing’ is needed and it should be done document-by-document. In such a situation, the hearing on the case was adjourned for a month.

  • On October 12, 2023, the court had cited lack of time to hear the bail petition. This happened when Kapil Sibal had said – I can show in 20 minutes that no case can be made against Umar Khalid.

  • Senior counsel was not available on November 29, 2023. In such a situation, a joint request was made from both the parties.
  • In December 2023, Umar Khalid completed 3 years and 3 months in jail.
  • Additional Solicitor General SV Raju was not available on January 10, 2024 and the representative sought additional time. In such a situation the hearing was postponed.
  • On January 24, 2024, the matter was listed at 12:45 pm, just before the lunch break. Due to lunch at 1 o’clock, the judges’ bench had got up in the court and after lunch he had to hear the cases. Umar Khalid completed a total of 1227 days in imprisonment that day.
  • On January 31, 2024, the bench had a lot of cases, some of which were related to the Enforcement Directorate (ED). In such a situation, the court said- We will hear the bail petition on 1st February.

  • On February 1, 2024, the bench of Justice Trivedi and Justice Mittal had adjourned the hearing and listed the petition for February 7.

  • On February 7, 2024, it was told that Justice Trivedi is in the Constitution Bench for a week. In such a situation, the next date of hearing cannot be announced.
